Orders of Protection

Long Island Domestic Violence Lawyers

If you are a victim of domestic violence or abuse, you should speak with an attorney who can help you obtain an order of protection.  You have the right to apply for an order of protection, sometimes referred to as a protective order or restraining order, against any member of your family who threatens to harm or who has actually harmed you or your children.

Orders of protection area extremely effective in protecting people from all types of domestic violence or abuse, including:

  • Physical Abuse
  • Emotional Abuse
  • Sexual Abuse
  • Disorderly Conduct
  • Harassment
  • Stalking
  • Reckless Endangerment
  • Assault & Battery
  • Aggravated Assault & Battery

Helping Victims of Domestic Violence & Abuse

Many victims of domestic violence are unsure of who to trust and where to go for help.  Furthermore, a large majority of people who are abused or mistreated by a family member never speak up or ask for help out of fear of retaliation, shame or embarrassment.  At Samuelson Hause & Samuelson, we urge you to contact an attorney at our office who can help you seek the protection you need and deserve.  There are multiple types of protective orders, and we can determine which one would best serve your needs and situation.

There are two main types of orders of protection in New York:

  • Stay-Away Order:  This type of protective order prohibits the accused from coming within a certain distance of the victim, as well as from coming within a close distance of the victim's home, work, or any other place he or she frequents.  A victim can usually obtain a stay-away order that protects his or her children as well.
  • Refrain-From Order:  This type of protective order prohibits the accused from engaging in certain behavior, such as making threats against the victim, assaulting the victim, harassing the victim, or inflicting violence against the victim.  Refrain-from orders can also forbid the accused from making contact with the victim and his or her children, whether in person, over the phone, through email, via text message, etc.
